This document regulates the terms of use of the website and the acquisition of products and/or services through it, including purchases made by telephone or electronic means.

The User

By accessing, browsing, and using the Website, the user accepts these terms of use and assumes responsibility for their correct use, committing to:

  • Make purchases for personal use.
  • Provide truthful data when registering.
  • Be over 18 years old or have authorization from parents or guardians.
  • Formalize the sales contract in the available language.

Purchase Process

Registered users may acquire products or services by following the online purchase procedure at www.sunmarket.es. Selected products will be added to the cart, and payment will be processed by clicking on "Pay".

Purchases by Telephone or Telematic Means

In addition to online purchases, orders can also be made by telephone, WhatsApp, or email. In these cases, our advisors will provide a personalized quote to the user, and if the user accepts the quote by making the payment, it will be considered that they have formalized the order and accepted the general sales conditions.

Confirmation and Acceptance of the Order

The user will receive an email confirming the receipt of their order by Sunmarket. In case of purchase by telephone, WhatsApp, or email, the user will also receive confirmation of the order by these means.

Additionally, they will be notified by email when the order has been shipped, and this information may be available in their personal account on the website.

Upon completing the purchase process, the user consents to the issuance of an electronic invoice, which will be sent by email. If the user prefers, they can request a paper copy using the contact details mentioned above.

Particular Sales Conditions

The user acknowledges being informed about the particular sales conditions related to the products and/or services acquired. These include, but are not limited to:

  • Name
  • Price
  • Components
  • Quantity
  • Color
  • Product details
  • Service costs

By placing an order, whether by digital or telephone means, the user fully accepts these conditions.

Orders with Down Payment for Equipment or Machinery

  • Initial Deposit: For these types of orders, it is mandatory to make an initial payment or down payment. This payment guarantees the reservation and manufacturing of the requested equipment.
  • No Return of the Deposit: Under no circumstances will the money provided as an initial payment or deposit be returned. This is because the product has been specifically requested for the customer and, by its nature, cannot be marketed to another customer.
  • Obligation of Full Payment: The customer assumes the obligation to complete the payment for the equipment or machinery under the agreed terms. In case of non-compliance, Sunmarket reserves the right to claim the outstanding payment or take the necessary legal measures to enforce its rights.

Exceptions: Cancellations will not be accepted once the order has been sent to the factory or supplier, as these products are manufactured or requested on demand and according to the customer's specifications.

Cancellation Policy

The customer has the right to cancel an order before the manufacturing or customization process begins. If the cancellation occurs during this period, no additional charges will apply. However, once the manufacturing or customization process has begun, it will not be possible to cancel the order, and the customer must fulfill their purchase commitment.

Payment Methods

We accept the following payment methods:

  • Bank transfer
  • Cash on delivery
  • SeQura

SeQura is a financed payment method that allows users to pay in installments. Card payments are subject to the approval of the issuing bank. If the bank rejects the payment, Sunmarket is not responsible for delays or failures in delivery.

Delivery

We deliver worldwide. The usual delivery time is a maximum of 30 days from order confirmation, except under extraordinary circumstances. If Sunmarket cannot meet the delivery date, the user will be informed and may choose to continue with the purchase with a new delivery date or cancel the order, obtaining a full refund.

In case of the user's absence at the delivery address, a notice will be left indicating how to coordinate the new delivery or pick up the order.

Returns

The user, as a consumer, has the right to withdraw from the purchase within 14 days, except for customized products or those manufactured to order. To exercise this right, the user must contact Sunmarket through the available means on the website or the provided contact details.

Products must be returned in their original packaging and in perfect condition, including all accessories and manuals. Once the product is received and its condition verified, a refund will be processed. Return shipping costs may be borne by the user, except in the case of defective or incorrect products.

Right of Withdrawal

The user may withdraw from their purchase within 14 days from the receipt of the goods. To exercise this right, they must notify Sunmarket of their decision through the contact means provided on the website. Sunmarket will refund all payments received within 14 days from the withdrawal notification, except for additional shipping costs in case a more expensive shipping method was chosen.

Exceptions: This right of withdrawal will not apply to customized products, those made to order, or specifically requested for the customer. In these cases, the money paid as a deposit will not be refundable.

Warranties

The user has the right to warranties for the products purchased through this Website, in accordance with applicable legislation, for a period of two years from the delivery of the product. This warranty covers any lack of conformity that becomes apparent within this period.

Disclaimer of Liability

Sunmarket is not responsible for the following losses, regardless of their origin:

  • Losses not attributable to any breach by Sunmarket.
  • Business losses, including loss of income, contracts, expected savings, or data.
  • Other indirect losses that were not reasonably foreseeable at the time of contract formalization.

Product or Service Details

We strive to provide accurate descriptions of products and services on the website. However, prices and availability of products are subject to change without prior notice.

Written Communications and Notifications

By using this Website, the user agrees that most communications with Sunmarket will be electronic. All communications, whether by email or other telematic platforms, are private and confidential.

Intellectual Property

All intellectual property rights over the contents of this website belong to Sunmarket Wellness SLU or to third parties who have authorized their use. Reproduction or distribution of the contents without express authorization is prohibited.

Applicable Law and Jurisdiction

The use of the Website and the purchase contracts through it will be governed by Spanish legislation. In case of disputes, the user may resort to online conflict resolution methods, in accordance with Regulation (EU) 524/2013.

According to Regulation (EU) No. 524/2013 of the European Parliament and Council, users have the right to access the European Online Dispute Resolution platform (ODR) to resolve any disputes arising from transactions made with Sunmarket.
